About this contract
The London Borough of Havering invites expression of interest for Best Interest Assessment Services. The Best Interests Principle in the Mental Capacity Act (2005) (MCA) states that any act done, or decision made, on behalf of an adult lacking capacity must be in their best interests. This can cover financial, health, and social care decisions. The Deprivation of Liberty Safeguards (DoLS) are part of the MCA and provide legal protection for those vulnerable people who are, or may become, deprived of their liberty. The Safeguards aim to make sure that people in care homes and hospitals are looked after in a way that does not inappropriately restrict their freedom. Its purpose is to decide whether a deprivation of liberty is happening or may happen, and if it is, whether this is in the best interests of the person affected. The assessment must conclude whether or not the individual's liberty is being deprived, and if this is assessed as being in that individual's best interests, the Deprivation of Liberty is authorised by the Council.
