About this contract
The Mental Capacity Act 2005 makes it a legal requirement for a person lacking mental capacity to have independent advocacy when there are no known relatives or friends who it would be appropriate to consult. The IMCA service must represent all service user groups for vulnerable people aged 16 and over who lack the capacity to make important decisions about serious medical treatment and changes of accommodation e.g. moving care homes , and who have no family or friends that it would be appropriate to consult about these decisions. IMCAs will support service users' views and any decisions involving finance, personal welfare and health care shall be made in the best interests of the service user
